TERMS AND CONDITIONS OF USE

1. DEFINING ELEMENTS

       The general terms and conditions will apply to all sales of services offered by SC BALTA IANNIS SRL through the website www.laculiannis.ro.
       Thus, the following terms will mean:
“Buyer”  – the person, firm, company or other legal entity that makes a reservation.
“Seller”  – the commercial company SC BALTA IANNIS SRL, having its registered office in ORADEA, 9 CZARAN GYULA str., BIHOR county, no. of registration at the Trade Register: J05/1291/2016, CIF RO36264356.
“Intellectual Property Rights”  (hereinafter IPR) – all immaterial rights such as know-how, copyright and copyright, database rights, design rights, model rights, patents, trademarks and domain name registrations for any of the above.
“Specifications”  – all specifications and/or descriptions of the Goods and Services as specified in the Order.

2. THE SERVICES OFFERED

       • Access to fenced premises
       • Access to showers and toilets
       • Access to electricity
       • Fishing stand
       • Camping space
       • Car parking

       The rates displayed on www.laculiannis.ro/Tarife.php are expressed in RON and include VAT.
       SC Balta Iannis has the right to modify the rates displayed on www.laculiannis.ro/Tarife.php as well as the right to modify the characteristics of the packages offered at any time. Confirmed reservations will not be affected by these changes.
       The Seller is not responsible for guarding the parking lot and the Buyer’s personal belongings located in the fenced premises. However, the Seller has a video monitoring system for both the parking lot and the premises, the recordings of which can be made available to the Buyer and/or authorized institutions upon request.
       For details, please read carefully the Video Surveillance Policy.

3. MAKING THE RESERVATION

       Reservations can be made up to 365 calendar days in advance of the desired date.
       The customer undertakes to enter complete, correct and factual data in the Booking Form.
       After selecting the desired services, the Client will proceed to pay them according to the payment methods detailed in the Payment methods section.
       The reservation is assumed by the Seller only after sending a CONFIRMATION CODE to the e-mail address filled in by the Buyer in the Reservation Form.
       Domain registration is carried out in accordance with the legislation in force.
SC Balta Iannis SRL  cannot be held liable for any damages caused by the Customer providing incorrect or incomplete information.
       The client agrees to pay the value of our services in advance, for the time period in which they are provided: 72 hours, 96 hours, 120 hours, 144 hours, 168 hours for 1 or 2 fishermen.
       The fishing schedule is every day from 0:00 to 24:00.
       The handing over of the fishing stand to the comparator can be done throughout the reserved period, but not earlier than 2:00 p.m. on the first day of the reservation

       The schedule for handing over the stands to the Buyer is as follows:
       – Monday – Sunday from 07:00 to 21:00
       The schedule for handing over the stands from the Buyer to the Seller is as follows:
       – Monday – Sunday from 07:00 to 21:00
       It is at the Buyer’s choice whether to use the entire reserved time interval or only partially. The remaining time of the reservation, in case the Buyer hands over the fishing stand before the expiration date and time, is not transferable to another Buyer.
       The partial use of the time reserved by the Buyer does not influence the fee paid in any way. The Buyer agrees that the partial use/non-use of the reservation time cannot lead to the partial or total return of the amounts paid to the Seller.
       The release of the stand and its delivery is done by the Buyer no later than 12.00 on the last day related to the reservation.
       Minimum charging period 48 hours.

4. METHOD OF PAYMENT

       The payment can only be made online with the card through the online platform or by bank transfer, in complete security conditions. Cards accepted for payment are those issued under the logos VISA (Classic and Electron) and MASTERCARD (including Maestro, if they have a CVV2/CVC2 code).
       To complete the transaction correctly, you must provide the card code (all digits in the four groups on the front of the card, without spaces), the expiration date, the name of the holder and the last three digits on the back of the card written on the strip with your signature (depending card, some information may be missing).
       Card data processing is done exclusively through the online platform which does not request or store any other details related to your card.

Online with bank card through EuPlatesc (Visa/Maestro/Mastercard).
       If you have chosen the online payment method  by bank card,  it is necessary to fill in a form with the information about your card on the secure page of the payment processor.
        – Payments with credit/debit cards issued under the Visa and MasterCard logo (Visa/Visa Electron and MasterCard/Maestro) are made through the “3-D Secure” system developed by organizations that ensure online transactions the same level of security as those made at the ATM or in the physical environment, at the merchant.
        – “3-D Secure” primarily ensures that no information related to your card is transferred or stored, at any time, on the store’s servers or on the servers of the payment processor, these data being directly entered into the Visa systems and MasterCard.
Important to know! – No commission is charged for bank card payments!
       The Supplier (EuPlatesc.ro) will have no obligation (neither towards the End User nor towards the Beneficiary) to bear any of the expenses related to the unilateral termination of the contract by the End User and will not be liable in any way towards this.

5. RESERVATION CANCELLATION AND RETURN POLICY

       Any cancellation/modification of the reservation less than 30 calendar days before the reserved date, or non-appearance on the scheduled date, leads to the full retention of the fee paid by the Buyer.
       The buyer has the right to reschedule the fishing party, following which I would choose a stand and a period left free for that period. The request for rescheduling must be sent at least 14 days before the start of the fishing game.

       In case of cancellation of the reservation, the seller undertakes to return the full amount by bank payment to the comparator within a period of up to 14 working days.
       The request to cancel/modify the reservation can only be sent in writing via email: contact@laculiannis.ro, by the holder of the reservation. The cancellation/reservation request must include exactly the same data contained in the reservation together with the reservation confirmation code.

6. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS (IPR)

       The Buyer understands the intellectual property right and will not disclose to a third party or make public (on the Internet or the media), any of the information received from the Seller.
       Also, the name of the site as well as the graphic signs are registered trademarks owned by SC BALTA IANNIS SRL and cannot be taken over, copied or used, without the written consent of the owner.

7. PRIVACY POLICY

       Through this “Privacy Policy” we undertake to provide users with clear and complete information about the data we collect through the web domain www.laculiannis.ro and about how these data are stored and used by our company “Privacy Policy ” also explains how the user can manage preferences related to Internet browsing and cookies policy.
       SC Balta Iannis SRL. respects the right to privacy of the people who visit our website and communicate with us electronically. We thus developed this “Privacy Policy” with the aim of informing you about the way in which www.laculiannis.ro collects, uses and processes personal information.

Policy regarding the processing of personal data and video surveillance
       This privacy policy (“Policy”) applies to  SC Balta Iannis SRL . We strive to provide memorable services and experiences to all our customers. We are glad to have you as our customer and value your loyalty. We are aware that privacy is an important issue these days. We have developed this Policy to outline how we manage the personal information we collect from or about you on our website or at our premises, through written or oral communications with us, when you visit our property or from other sources.
       By using any of our services and/or accepting this Policy, for example in the context of registering for any of our products or services, you understand and acknowledge that we will collect and use personal data as described in this Policy.

8. BILLING

       The Seller will issue an invoice to the Buyer, after receiving the amounts in the Seller’s account, the Buyer’s obligation being to provide all the data necessary to issue the invoice in accordance with the legislation in force.

9. VIDEO SURVEILLANCE POLICY

1. The legitimate reason and legal basis of the video surveillance
       The use of the video surveillance system is necessary to maintain an optimal social climate and to increase the safety, security and access control in the premises of SC Lacul Iannis SRL, as provided by Law no. 333/2003 regarding the protection of objectives, assets, values ​​and the protection of persons, as well as Government Decision no. 301/2012 for the approval of the Methodological Norms for the application of Law no. 333/2003 regarding the protection of objectives, goods, values ​​and the protection of persons.

       Legal framework:
       • Law no. 333 of July 8, 2003 regarding the protection of objectives, goods, values ​​and the protection of persons, with subsequent amendments and additions;
       • Decision no. 301 of April 11, 2012 for the approval of the Methodological Norms of Law no. 333/2003 regarding the protection of objectives, goods, values ​​and the protection of persons;
       • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (Regulation general regarding data protection)
       • Instructions of the European Authority for the Protection of Personal Data regarding video surveillance.

2. The purpose and scope of the video surveillance policy
SC Balta Iannis SRL  operates a video surveillance system to prevent, deter, manage and investigate safety and security incidents, as well as for the protection of people and property (from fires, thefts, burglaries, attacks or any other threat). The video surveillance system supports the achievement of common security and access goals by monitoring specific areas and events. The system is part of the measures designed to support the security policies of  SC Balta Iannis SRL
       This policy establishes the mechanisms for using the video surveillance system, as well as the measures adopted by  SC Balta Iannis SRL  to protect the personal data and private life of the people inside the premises SC Balta Iannnis SRL and in its immediate vicinity.
       The elements of this surveillance policy are applicable within  SC Balta Iannis SRL .

3. Ensuring the operation of the video surveillance system in accordance with the legislative provisions regarding private life and data protection

3.1. Review of the current system
       The procedures  of SC Balta Iannis SRL  are periodically reviewed, to ensure compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 regarding the protection of natural persons with regard to the processing of personal data and on the free circulation of this data and repealing Directive 95/46/EC (General Data Protection Regulation)

3.2. Compliance
SC Balta Iannis SRL  processes images in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repeal of Directive 95/46/EC (General Data Protection Regulation).

3.3. CCTV system
       The closed-circuit television (CCTV) system of  SC Balta Iannis SRL  can be periodically subjected to a risk analysis for each individual surveillance camera. Based on the analysis and with the objective of minimizing the monitoring of areas that are not relevant for the intended purposes, the location of the cameras and the viewing angles can be modified, replaced or confirmed.

3.4. Policy review
       The system operator performs a review of the proportionality of the use of the video surveillance system on the protection of personal data every two years. During these periodic revisions, it will assess whether:
       • there is still a need for a video surveillance system;
       • the system continues to serve its stated purpose;
       • there are still no suitable alternatives.

       The periodic reviews will also cover other problems identified during the operation of the system, especially if  SC Balta Iannis SRL’s  video surveillance policy continues to comply with the legislation and instructions in force and if it is respected in practice.

3.5. Technological solutions that respect privacy
       When ordering new equipment for the system and, as far as possible,  SC Balta Iannis SRL  will use the optimal technological solutions, which meet the standards and the level of the latest technologies available.

4. The areas under surveillance
       The location of the surveillance cameras and their viewing angles is based on a risk analysis, ensuring that the cameras are oriented exclusively towards the most important areas within the monitored objective.
       To monitor the entry/exit points, the fishing stands of  SC Balta Iannis SRL premises , surveillance cameras are provided.

5. Categories of personal data collected and the purpose of their collection

5.1. Technical characteristics of the system The SC Balta Iannis SRL  video surveillance system is a conventional system
       . All surveillance cameras work 24 hours/day, 7 days/week. The quality of the image in most cases allows the identification of people in the coverage area of ​​the surveillance camera. It records digital images by recording the captured images as well as the time, date and place. We do not use cutting edge technology or intelligent video surveillance, we do not interconnect our system with other systems and we do not use audio recordings or “CCTV with sound”.

5.2. The purpose of video surveillance
SC Balta Iannis SRL  uses the surveillance system to guarantee safety, security and access control. The surveillance system contributes to the control of access to the building and ensures the security and safety of the buildings, staff, tourists and visitors, as well as the goods and documents present or kept in the premises.
       The video surveillance system helps prevent, deter, manage and, if necessary, investigate safety and security incidents, potential threats or unauthorized physical access, including unauthorized access to buildings or IT infrastructure.

5.3. Purpose limitation
       The system is not used for purposes other than those mentioned above. For example, it is not used to monitor employee attendance. The system is not used as an investigative tool for purposes other than those described above, unless it is a physical security incident or a crime. The recordings can be sent to investigative bodies as part of an official disciplinary or criminal investigation.
5.4. Webcams
SC Balta Iannis SRL  does not use webcams for purposes related to the protection of safety and security.

5.5. Special categories of data
       The video surveillance system of  SC Balta Iannis SRL  does not aim to collect special categories of data, such as racial or ethnic origin, political opinions, religious or philosophical beliefs, union membership or data regarding health or sexual orientation . However, the system may process special personal health data in the situation where among the tourists or hotel visitors there are people with visual impairments or people with physical disabilities (for example, those in wheelchairs or using the access ramp intended for them) .
       The CCTV system monitors the minimum area necessary to ensure the safety and security of the premises. The purpose of using these cameras is not to record or process special categories of data, nor to target an individual, but to be able to prevent, assess and investigate security-related incidents.
       The operators of the monitoring systems benefit from periodic instructions regarding data protection and fundamental rights.

6. The right of access to information and its beneficiaries

6.1. Internal and external security and maintenance staff
       The CCTV computer system does not allow external operators to download recordings to external media (such as DVDs or USB keys).
       The maintenance of the video surveillance system is also carried out by a contractor, under the supervision of a representative of  SC Balta Iannis SRL .

6.2. The right of access to personal data
       The security policy of  SC Balta Iannis SRL  regarding video surveillance specifies and documents who has access to video surveillance recordings and/or to the technical architecture of the video surveillance system, for what purpose and what the rights consist of respective access. In particular, the document specifies who has the right:
       • to view the images in real time;
       • to view the recorded images;
       • to copy;
       • to download;
       • to delete;
       • to modify images.
       Access rights are established by the decision of  SC Balta Iannis SRL management .

6.3. Staff training on data protection         All staff with access rights, including external security guards and maintenance technicians, receive training on data protection.

6.4. Confidentiality Commitments
       Personnel with access rights, including external personnel performing CCTV operations or system maintenance, sign confidentiality commitments to ensure that they do not transmit, show or disclose the contents of video surveillance images to anyone in any way, except authorized recipients.

6.5. Transfers, communications and records
       Information gathered as a result of the processing of personal data, including CCTV images, may be disclosed to judicial or law enforcement authorities to investigate or prosecute criminal offences. These transfers are only made upon request. There are no periodic or routine transfers.
       Also, people who have suffered material damage in the premises of  SC Balta Iannis SRL  can request on the basis of a written request, subject to the approval of the management, access to view the relevant video recordings of the incriminated act.

7. Protection of personal data
       In order to protect the security of the video surveillance system as a whole, including personal data, a series of technical and organizational measures are put into practice.
       All possible technical and physical measures are taken to ensure system security and ensure data protection, among others:
       • staff (external and internal) sign non-disclosure and confidentiality agreements;
       • users are granted access rights only to those resources that are strictly necessary to carry out their activity (on a need-to-know basis);
       • drawing up an updated list of all functions/positions that have access to the system at all times and describes their access rights.

       8. Data retention
       The retention period of the images captured by the video surveillance system is a maximum of 2 months. This retention period is essential for security investigations, because due to the presence of users in various places of activity, in many cases complaints are filed long after the incident.
       If there is a need for an image to be retained for further investigation or to provide evidence in the event of a security incident, it may be retained for the duration of the investigation and, if necessary, may be archived with the investigation for a period of up to at one year.

10. PROMOTIONS

       All promotions are subject to availability and inventory. SC Balta Iannis SRL . reserves the right to change, modify or cancel promotions at any time and without prior notice.
